In Queensland, if you’ve been injured due to someone else’s negligence - whether in a workplace accident, public space incident, or other situations - you’re typically claiming against their insurance, not the individual or organisation directly. One benefit is that this helps ensure your compensation claim avoids unnecessary confrontation.
NDIS claims are usually straightforward.
The personal injury compensation system in Queensland is designed to deliver fair outcomes efficiently. Your claim can cover medical expenses, rehabilitation costs, lost income, and other damages. Most claims follow a structured process, leading to a single comprehensive settlement that helps you move forward.
Time limits apply - act fast
Strict deadlines apply to personal injury claims in Queensland. Most claims must be filed within three years, but some require action much sooner. Whilst not usually fatal to a claim, there are procedural time limits during which claim forms should be lodged. Motor vehicle accident claims should be lodged within 9 months of the accident or a reasonable excuse for delay is required, or just 3 months if the at-fault driver is unregistered, uninsured or un-identified (within the 3 year time limit reducing to only 9 months from the accident). Public liability claim forms should also be lodged within 9 months of the accident where possible. Applications for workers' compensation must be submitted within 6 months. Institutional abuse claims do not have a time limit (you can claim abuse even if it occurred decades ago) but early action helps preserve crucial evidence.
